General Provisions

These general conditions regulate the purchase of products and services carried out remotely via the Internet on the Website, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree no. n. 206/5005, modified by the D. lgs. n. 21/2014 and by the Legislative Decree 70/2003 on electronic commerce.

Before sending the order, the Customer is required to read carefully these Terms and Conditions, made available on the aforementioned Site to allow the reading, storage and archiving. In the order confirmation email, the Customer will also receive a link to download and store a copy of these general conditions of sale, as provided for by art. 51 paragraph 1 of Legislative Decree. 206/2005, amended by Legislative Decree no. 21/2014. These conditions may be subject to change and the date of publication of the same on the site is equivalent to the date of entry into force.

Art. 1 – Definitions

Except as otherwise provided in the Contract, the following terms and expressions will have the meaning given below:

  1. “Biofarma S.p.A.”, hereinafter referred to as: “SportCube”: registered office and warehouse in via Castelliere, 2 – 33036 Mereto di Tomba (UD), P.I. 02895910301, tel. +39 0432868711, email
  2. “Site” or “Website”: the site accessible at the URL, owned by Biofarma S.p.A.
  3. “Customer”: the natural person who concludes the contract for the purchase of one or more Products.
  4. “Consumer” or “Consumer Customer”: the Customer (natural person) acting for purposes unrelated to any business, commercial, craft or professional activity carried out.
  5. “Professional” or “Professional Client”: the Customer (natural or legal person) acting in the exercise of his business, commercial, craft or professional activity, or his intermediary.
  6. “Parties”: SportCube and the Customer.
  7. “Product”: each product made available for purchase through the electronic catalog made available on the Site. The catalog is constantly updated and the availability of each product may change without notice.
  8. “Access Credentials”: the “username / email address” and the “password” relating to the account of each Customer, necessary for access to the reserved area of ​​the Site and to conclude the Contract.
  9. “Working days” and “working hours”: from Monday to Friday, except national holidays and possible closures for working periods (August, December), with working hours from 8.00 to 13.00 and from 14.00 to 17.00.
  10. “General Conditions”: these General Conditions of Sale, which regulate the relationship between SportCube and Consumer Customers.
  11. “Contract”: consists of these General Conditions and the Order Confirmation. In case of discrepancy between the General Conditions and the Order Confirmation, the Order Confirmation will prevail.

Art. 2 - Parts of the Contract

  1. Parts of the contact are SportCube and the Consumer Customer, whose personal data are indicated in the Order Confirmation sent by SportCube: it forms an integral part of the Purchase Contract. The data of Sportcube are indicated in art. 1, paragraph 1, lett. a, of the General Conditions.
  2. The contract stipulated between SportCube and the Consumer Customer is subject, inter alia, to the specific regulations in Section II (“Pre-contractual information for the consumer and right of withdrawal in distance contracts and contracts negotiated away from business premises”) , art. from 49 to 59, as well as sections III (“Other consumer rights”), art. from 60 to 65, and IV (“General Provisions”), art. from 66 to 67, of the Legislative Decree 206/2005 (“Consumer Code”). Before the conclusion of the purchase contract, the Customer takes note of the characteristics of the goods that are illustrated in the individual product data sheets at the time of the Customer’s choice.

Art. 3 - Object of the Contract

  1. These General Conditions of Sale for Consumer Clients (“General Conditions”) govern the purchase, made by Consumers Customers, of the products referred to in the electronic catalog made available on the website (“Site”) and / or Facebook showcase. The contract is concluded exclusively through the Internet, by accessing the Customer at and / or Facebook and the creation of a purchase order according to the procedure provided by the site and / or Facebook window.
  2. These General Conditions do not apply to contracts concluded with Professional Customers. Should a Professional Customer still conclude the sales contract with Sportcube through the B2C section, the rules protecting the Customer Consumer will in no case be applicable in his favor.
  3. These General Conditions apply to all purchases referred to in paragraph 1 carried out starting from 15/05/2017. The Customer undertakes to examine, before proceeding to confirm his order, the following General Conditions of Sale.

Art. 4 - Sales procedure and conclusion of the Contract

  1. Upon registration to the Website, the Customer may purchase one or more Products present in the electronic catalog of the Site (illustrated and described in the relevant information sheets) inserting them in the “shopping cart” and respecting the technical access procedures referred to in the Website itself.
  2. The publication of the Products indicated on the Website and / or the Facebook showcase constitutes an invitation to the Customer to make a purchase contract proposal to SportCube. Before sending the order, the customer is shown a page that summarizes, among other things, the selected products, their price and any delivery costs. The general conditions and the privacy policy can be viewed, saved and printed before sending the order.
  3. The order sent by the Customer has the value of a contract proposal and, by sending this order, the Customer acknowledges having complete knowledge and fully accepting these General Conditions. The Customer is invited to print and keep the order summary, shown after the sending of the same through the Site. The “notes” field present in the electronic order form can be used by the Customer only to insert any operational indications ( eg, name on the intercom) and will not in any way bind any part of the Contract, nor may it contain exceptions to these General Conditions or in any case to the contractual ones.
  4. SportCube has the right to accept, within 14 working days, at its discretion, the order sent by the Customer, without the latter being able to make any claims or rights whatsoever, in any capacity, in case of non-acceptance of the order. Any acceptance of the Customer’s proposal is confirmed by SportCube through an e-mail message confirming the order to the e-mail address provided by the Customer. The purchase contract stipulated between SportCube and the Customer is concluded with the sending of the order confirmation to the Customer by SportCube, without prejudice to the verification referred to in paragraph 5. The email contains the data of the Customer and the order number, the price of the goods purchased, shipping costs and the delivery address to which the goods will be sent and the link to print and store the copy of these conditions. The Customer undertakes to verify the correctness of the personal data contained therein and to promptly notify SportCube of any corrections.
  5. The Customer acknowledges that the order confirmation referred to in the preceding paragraph is sent following an automated check. If, upon packaging and shipping of the Products, SportCube should find any errors in the catalog or in the order relating to the price and / or features and / or availability of a Product, SportCube will promptly notify the Customer in order to agree on the modification or cancellation of the order.
  6. The customer, as a consumer, can exercise the right of withdrawal under the terms and conditions of the law, in relation to which reference should be made to articles. 18 (“Right of withdrawal”) and 20 (“Cases of exclusion of the right of withdrawal”) of these General Conditions.
  7. The Customer acknowledges that certain products on the S2ito and / or Facebook showcase could: be packaged and / or personalized in its favor; risk deteriorating or expiring rapidly; not to be returned for reasons of hygiene or health protection, if sealed and opened after delivery; by their nature, inseparably mix with other goods, after delivery. Therefore, certain rights to the same due, even as a Consumer, could be limited (as, by way of example and not exhaustively, in accordance with the provisions of Article 20 (“Cases of exclusion of the right of withdrawal”).

Art. 5 - Description and visual representation of the goods

  1. SportCube undertakes to describe and present the items sold on the Website and / or showcase Facebook in the best possible way. The visual representation of the products on the Website and / or Facebook window, where available, normally corresponds to the photographic image of the products themselves and / or their packaging. This representation has the sole purpose of presenting them for sale, without any guarantee or commitment, on the part of SportCube, about the exact correspondence of the image depicted on the Website with the actual product.
  2. In the event of a difference between the image and the written product sheet, the description of the product sheet always prevails.

Art. 6 - Product availability

  1. The Customer can only purchase the goods present in the catalog published on the Website and / or showcase Facebook, and in the quantities indicated therein. The prices and availability of products, as reported on the Site and / or showcase Facebook, are subject to change at any time, without notice.
  2. On the Site and / or Facebook window the products available for shipping are highlighted. The Customer acknowledges that, due to the possible simultaneous access to the Website and / or Facebook window by several users and the time between loading the web page and inserting the cart, the actual availability of individual Products may vary sensibly during the same day with respect to the indications shown on the Website and / or Facebook window. When the order proposal is sent by the Customer, the computer system of the Site and / or Facebook window verifies the actual availability of the Products purchased and notifies them of any unavailability of one or more Products before the Customer makes the payment. Sportcube undertakes to fulfill its obligations in a short time and in any case in the manner and within the terms set forth in art. 11 of these General Conditions; if the delivery time of the ordered product is delayed compared to those indicated on the Site and / or Facebook window before the order, Sportcube undertakes to promptly notify the Customer via an electronic post message to the address indicated by the Customer in phase of purchase of products. If it is not possible, for any reason, to proceed with the delivery of the products purchased in compliance with art. 11 of these General Conditions, Sportcube reserves the right to notify the Customer of the cancellation of the order.
  3. If the Customer requests the cancellation of the order, resolving the contract, Sportcube will refund the amount paid within 10 working days from the day on which Sportcube was aware of the Customer’s decision to terminate the contract.

Art. 7 - Prices and delivery costs

  1. Il Cliente pagherà a SportCube il prezzo di cui alla pagina di conferma dell’ordine. Tutti i prezzi dei Prodotti sono indicati sul Sito e/o vetrina Facebook, sono espressi in Euro e si intendono comprensivi solamente di IVA. Nel caso in cui un Prodotto sia scontato, sono indicati la percentuale di sconto, il prezzo originario od ordinario e il prezzo finale.
  2. Il Cliente accetta la facoltà di SportCube di modificare i suoi prezzi in qualsiasi momento. Tuttavia la merce sarà fatturata sulla base dei prezzi indicati sul Sito e/o vetrina Facebook al momento della creazione dell’ordine e indicati nell’e-mail di conferma inviata da SportCube al Cliente.
  3. In caso di errore informatico, manuale, tecnico, o di qualsiasi altra natura che possa comportare un cambiamento sostanziale, non previsto da SportCube, del prezzo di vendita al pubblico, che lo renda esorbitante o chiaramente irrisorio, l’ordine sarà considerato non valido e annullato e l’importo versato dal Cliente sarà rimborsato entro 14 gg. dal giorno dell’annullamento.
  4. L’ammontare del minimo d’ordine a carrello per acquisti sul Sito è di € 10.00, eccezion fatta per periodi promozionali in cui l’ordine potrà essere variato. In tal caso ne verrà data comunicazione al Cliente in apposito banner promozionale all’interno del sito.
  5. I costi di spedizione non sono compresi nel prezzo d’acquisto, ma sono indicati e calcolati al momento della conclusione del processo di acquisto prima dell’effettuazione del pagamento. Le spese di spedizione sono attualmente gratuite per ordini il cui ammontare è pari o superiore a € 60.00 e l’indirizzo di consegna è ubicato in Italia. Per ordini di importo pari o inferiori a € 60.00 le spese di spedizione sono fissati in modo forfettario a € 6.50. 
  6. L’ammontare delle spese di consegna, ove dovute, è indicato nella pagina riepilogativa dell’ordine mostrata al Cliente prima dell’invio dell’ordine stesso.
  7. In caso di pagamento con contrassegno, sarà applicata una piccola commissione di € _____ per ordini inferiori a € _____ per il recupero delle spese previste dal corriere; per ordini superiori a tale importo, la commissione sarà ____ .
  8. Qualora il Cliente (o l’incaricato al ritiro) non si rendesse disponibile nel giorno previsto di consegna, il Cliente verrà contattato da parte di un loro incaricato, per concordare la consegna. La consegna verrà effettuata nel giorno lavorativo e nell’orario indicato dal Cliente, in un intervallo di 2 ore. In questo caso SportCube non è responsabile del mancato rispetto dei tempi di consegna previsti per la gestione ordinaria di un ordine.
  9. Il Cliente è tenuto a controllare la correttezza dei propri recapiti (indirizzo, numero di telefono, email, ecc.) inseriti nel Sito e a comunicare tempestivamente a SportCube eventuali correzioni. Qualora tali dati dovessero essere errati, la Società di spedizione non sarà in grado di contattarlo.

Art. 8 - Terms of payment

  1. I pagamenti in esecuzione del Contratto d’acquisto potranno essere effettuati attraverso contrassegno o carta di credito indicata sul Sito e/o vetrina Facebook o carta prepagata o sistema PayPal® o bonifico bancario anticipato. Il Cliente è tenuto a scegliere, al momento della conclusione del Contratto d’acquisto, la modalità di pagamento prescelta. Le comunicazioni relative al pagamento e i dati comunicati dal Cliente nel momento in cui questo viene effettuato avvengono su apposite linee protette.
  2. Pagamento mediante contrassegno
    1. In caso di acquisto con pagamento mediante contrassegno, il pagamento dovrà essere eseguito esclusivamente con denaro contante, in Euro e per un importo massimo di € _____, al corriere che effettuerà la consegna. Il Cliente dovrà predisporre la somma esatta indicata nella Conferma dell’ordine e riconosce che il corriere non dispone solitamente di resto. Non saranno accettati in nessun caso altri mezzi di pagamento, come, a titolo esemplificativo e non esaustivo, assegni circolari e bancari. Non è applicato alcun sovrapprezzo in caso di pagamento mediante contrassegno.
    2. In caso di mancato pagamento da parte del Cliente del prezzo pattuito, per qualsiasi ragione o causa, o in caso di non accettazione della spedizione o di suo mancato ritiro, SportCube inviterà il Cliente a provvedere al saldo, con riserva di ogni ulteriore azione. Sino a quando il Cliente non avrà regolarizzato la propria posizione debitoria con SportCube, quest’ultima si riserva di annullare le eventuali successive consegne di prodotti, di risolvere eventuali Contratti d’acquisto in essere nonché bloccare le funzioni d’acquisto attraverso il Sito, impregiudicato il risarcimento di ogni eventuale ulteriore danno.
  3. Pagamento mediante carta di credito o sistema PayPal®
    1. Qualora il Cliente proceda all’acquisto dei prodotti con pagamento mediante carta di credito o sistema PayPal®, le informazioni relative alla carta di credito dell’acquirente saranno trasmesse e gestite da un terzo soggetto (“Intermediario”), tramite connessione protetta direttamente al sito web dell’Intermediario che gestisce la transazione. I circuiti accettati sono indicati sul Sito prima dell’invio dell’ordine.
    2. La sicurezza del pagamento con carta di credito è garantita dalla connessione HTTPS con crittografia TLS.
    3. La procedura di pagamento mediante carta di credito si svolge utilizzando una connessione protetta, in cui il Cliente troverà l’indicazione dell’importo dell’ordine e dovrà indicare tipo, numero e data di scadenza della carta di credito. Ulteriori dati o codici di sicurezza potranno essere richiesti in taluni casi dall’Intermediario (come, a titolo esemplificativo e non esaustivo, per i servizi di sicurezza MasterCard SecurCode® o Verified® by Visa). È sempre richiesta l’indicazione di un numero di telefono ove il Cliente possa essere contattato.
    4. Al fine di tutelare in massimo grado la sicurezza del Cliente, SportCube non viene mai a conoscenza del numero della carta di credito, che viene ricevuto solamente dalle istituzioni bancarie che devono fornire l’autorizzazione. A SportCube viene unicamente comunicato l’esito della transizione. Nessun dato relativo alla carta di credito viene, in altri termini, trascritto sui documenti relativi all’ordine e/o memorizzato da SportCube.
  4. Pagamento mediante bonifico bancario anticipato
    1. In caso di acquisto con pagamento mediante bonifico bancario, in esplicita deroga all’art. 10 delle presenti Condizioni Generali (“Tempi di spedizione e consegna”), l’ordine sarà evaso successivamente alla effettiva ricezione della somma. La causale del bonifico bancario dovrà riportare il numero d’ordine e le generalità del Cliente. Il Cliente dovrà inviare copia della contabile bancaria tramite fax al n. _______ o email all’indirizzo: _____
    2. Il bonifico bancario dovrà essere effettuato dal Cliente entro 5 giorni lavorativi dall’accettazione da parte di SportCube, a pena di annullamento dell’ordine medesimo.
    3. I dati per il pagamento tramite bonifico son i seguenti: _____ . I dati per effettuare il bonifico sono contenuti anche nella e-mail di conferma dell’ordine.
    4. Le spese che il Cliente dovrà eventualmente corrispondere al proprio istituto di credito per effettuare il bonifico non saranno in alcun modo imputabili a SportCube. Il Cliente è pregato di informarsi previamente presso il proprio istituto di credito dei costi che dovrà sostenere per effettuare questa tipologia di pagamento.
    5. SportCube si riserva, a suo insindacabile giudizio, il diritto di non procedere alla spedizione della merce, anche dopo aver accettato l’ordine a quei clienti che risultassero fuori fido, ovvero con insoluto o, in contenzioso.

Art. 9 - Transport documents

  1. For each Purchase Agreement perfected through the Website and / or Facebook window, Sportcube will issue an invoice for the products that will be shipped.
  2. The information is provided by the customer when ordering the invoice. The Customer assumes all responsibility for the correctness of the aforementioned information. No change in the invoice will be possible after the issuance of the same.

Art. 10 – Tempi di spedizione e di consegna

  1. SportCube provvederà all’evasione dell’ordine normalmente entro 24/48 ore (eccettuati weekend e festivi) dal giorno di ricevimento dello stesso. Con l’evasione dell’ordine, SportCube affida i Prodotti al corriere o spedizioniere di fiducia per l’invio presso l’indirizzo indicato dal Cliente, riepilogato nella conferma d’ordine. Le consegne avvengono tramite trasporto via terra indicativamente entro le successive 24/48 ore (esclusi il fine settimana e i giorni festivi).
  2. Nel caso in cui si verifichi un problema al corriere durante il trasporto e il pacco non arrivi a destinazione entro il termine indicativo di cui al comma 1, il Cliente può segnalarlo tempestivamente a SportCube, che tenterà di risolvere la questione in un ragionevole periodo di tempo. SportCube invita il Cliente a non contattala prima che sia decorso il predetto termine indicativo, poiché non disporrebbe dei dati necessari per potersi proficuamente attivare presso il corriere incaricato.
  3. I termini di evasione e di consegna di cui al comma 1 sono solo indicativi e non garantiti, in virtù delle molteplici variabili in gioco, con particolare, ma non esclusivo riferimento alla fase di consegna da parte del corriere. In osservanza della normativa vigente, SportCube si impegna a consegnare i prodotti al consumatore entro 30 giorni dalla data di conclusione del contratto.
  4. I tempi di consegna sono riferiti ai prodotti presenti nel magazzino al momento dell’ordine di acquisto. Nessuna responsabilità potrà essere imputata a SportCube per ritardi nella consegna della merce dovuti a caso fortuito o forza maggiore, nonché in caso di scioperi, eventi atmosferici, festività particolari, inventari di magazzino, trasferimenti di sede, modifiche ai sistemi informativi e altri eventi straordinari; essi sono idonei a cagionare tempi superiori a quelli indicativi nell’evasione degli ordini, anche nell’ordine di diversi giorni.
  5. In caso, qualora i tempi di consegna del Prodotto ordinato dovessero subire ritardi rispetto ai tempi di consegna indicati sul Sito e/o vetrina Facebook prima dell’ordine, SportCube si impegna a farne pronta comunicazione al Cliente tramite un messaggio e-mail inviata all’indirizzo indicato dal Cliente medesimo.
  6. Qualora SportCube non sia in grado di effettuare la consegna nei termini di legge, il Cliente è obbligato a formulare invito alla medesima affinché la consegna possa effettuarsi in un termine supplementare appropriato alle circostanze.

Art. 11 – Consegna dei prodotti

  1. Tutte le consegne dei prodotti saranno a rischio di Sportcube sino al momento in cui il Cliente o un terzo da lui designato entra materialmente in loro possesso.
  2. I termini di consegna indicati sul Sito e/o vetrina Facebook sono riportati a titolo indicativo. SportCube si impegna a consegnare i prodotti al consumatore entro 30 giorni dalla data di conclusione del contratto. Nessuna responsabilità, a qualsiasi titolo, può essere addebitata dal Cliente a SportCube qualora i prodotti non vengano consegnati secondo i termini indicati sul Sito e/o vetrina Facebook.
  3. Salvo diversa comunicazione inviata dal Cliente da parte di SportCube, la consegna dei prodotti si intende a piano strada.
  4. Allo scopo di effettuare la consegna dei prodotti ordinati, è necessaria la presenza del Cliente o di un suo incaricato nel luogo indicato dal Cliente, che accetterà dunque il pacco per suo conto. Gli orari di consegna del corriere sono solitamente compresi fra le  ___ e le ___. In caso di assenza del Cliente (o di un suo incaricato), lo spedizioniere lascerà un avviso con le indicazioni per poter concordare una diversa data di consegna.
  5. Qualora la consegna non avvenga per causa imputabile al Cliente (ad esempio, per sua assenza e/o per suo mancato contatto con il corriere a norma del comma 4), questi è tenuto al pagamento dei costi di spedizione sostenuti da SportCube.
  6. Qualora SportCube non sia in grado di effettuare la consegna nei termini di legge, il Cliente è obbligato a formulare invito alla medesima affinché la consegna possa effettuarsi in un termine supplementare appropriato alle circostanze.
  7. Per ogni ordine effettuato sul Sito e/o vetrina Facebook, SportCube emette fattura della merce spedita. La fattura verrà inviata al Cliente tramite e-mail allo stesso indirizzo di posta elettronica utilizzato dal Cliente per effettuare l’ordine. Dopo l’emissione della fattura, non sarà possibile apportare alcuna modifica ai dati indicati nella stessa.

Art.12 - Verification operations at the time of delivery of the products

  1. At the time of delivery of the products by the forwarder appointed by SportCube, the customer is required to check that the number of items delivered corresponds to those indicated in the transport document on the package and that the package is intact, not damaged or in any case altered, also in the closing materials, checking with particular care the presence of signs indicating the breaking of the goods sent.
  2. On penalty of forfeiture, any damage to the packaging and / or products and / or mismatch in the number of packages and / or indications must be immediately challenged by the Customer who must declare, in writing, to the person responsible for the delivery of the products, that they are accepted “subject to control” or indicating that they are “damaged”: in the absence, no claim will be accepted. The Customer undertakes, moreover, to promptly report, and in any case no later than 24 hours from the date of delivery, to SportCube (by e-mail or registered letter with acknowledgment of receipt to the address referred to in Article 1 of these Conditions Generali) any and any problems inherent in the integrity, correspondence and / or completeness of the products received, under penalty of forfeiture.

Art. 13 - Force majeure and facts of third parties

  1. SportCube is not liable for cases of force majeure, unavailability of means of transport, third parties, unpredictable or unavoidable events that cause delays in delivery and / or make deliveries difficult or impossible or cause a significant increase in the cost of delivery charged to SportCube.
  2. In the cases referred to in the previous paragraph, SportCube has the right to split, postpone or cancel, in whole or in part, the intended delivery or to terminate the Purchase Contract. In such cases, SportCube undertakes to provide timely and appropriate communication of its determinations to the e-mail address indicated by the Customer, who has, in this case, the right to the refund of any already paid price, excluding any further claim, to any title, against SportCube. In this sense, the Customer expressly renounces any claim, even as a mere repayment and / or indemnity, against SportCube.

Art. 14 - Custody and conservation of products

  1. Products sold by SportCube must be kept and stored by the Customer using the precautions and precautions necessary for the purpose of the products themselves.
  2. The negligence and / or inexperience in the conservation of each product can damage it and compromise its qualities. SportCube shall not be liable for any damage to the products sold deriving from erroneous and / or incorrect conservation of the same, with the express expiry of any warranty with respect to them.

Art. 15 - Warranty

  1. The consumer customer enjoys both the ordinary warranty provided by the Civil Code, referred to in this article, and the warranty for any lack of conformity required by the Consumer Code, referred to in the article below.
  2. Sportcube guarantees that the products are free from material and manufacturing defects for a period of 24 months from delivery, subject to the limitations set forth in art. 17 (“Exclusions and limitations of the guarantee”). In case of receipt of non-conforming or defective products, the Customer has the right to the restoration without expenses of the conformity of the product by replacing the Product. The Customer can exercise this right if the defect manifests itself within the terms established by the Legislative Decree. 206/2005.
  3. During the warranty period, the Products and their accessories (if defective according to the preceding paragraph) will be repaired or replaced by Sportcube at no expense either for the spare parts or for the labor (where applicable). The inactivity of the Products determined by the repair periods does not imply an extension of the warranty period.

Art. 16 - Additional legal warranty for the Consumer Customer

  1. In addition to the warranty provided for the defects of the thing sold under the provisions in force, up to two (2) years from the delivery of the Products, Sportcube is liable to Consumers Customers, pursuant to articles. 130 and 132 of Legislative Decree. 206/2005, of any lack of conformity of the existing products at the time of delivery. The lack of conformity is considered subsistent if: (i) the product is not suitable for the use to which goods of the same type are normally used; or (ii) does not conform to the description or does not possess the qualities referred to in the sample or model possibly shown by Sportcube; or (iii) does not offer the usual qualities and services of a good of the same type that the Consumer may legitimately expect; or (iv) is not suitable for the particular use intended by the Consumer if brought to the knowledge of the seller at the time of purchase and accepted by Sportcube.
  2. The Consumer Customer lapses from the rights granted to him by art. 130, paragraph 2 of Legislative Decree. 206/2005 if it does not report to Sportcube the lack of conformity within the term of the two (2) months from the date on which it discovered the defect.
  3. Sportcube will make every diligent effort to replace at its own expense and expense, with other products of the same quality and title available in its warehouses, those delivered Products that are damaged or defective, provided they have been returned by the Customer in the original packaging (complete with all the parts that compose it). If replacement with the same product is not possible, Sportcube will reimburse the Customer for the amount paid for the defective product, excluding any further liability of Sportcube, for any reason.
  4. The cases of exclusion and limitation of the guarantee are explained in art. 17 (“Exclusions and limitations of the guarantee”).

Art. 17 - Exclusion and limitation of warranty

  1. The guarantee referred to in articles 15 (“Warranty”) and 16 (“Additional legal guarantee for the Consumer Customer”) is excluded if the Customer has damaged the Products for his own willful or negligent conduct, or in any case if, by his negligence and / or carelessness and / or for other reasons not attributable to Sportcube, have damaged and / or rendered the Products defective, and / or exposed them to natural events and / or used them improperly and / or without following the technical instructions indicated in any manuals, and / or have carried out and / or have performed by personnel not authorized by Sportcube repairs, interventions or tampering, and / or have omitted the necessary maintenance, and / or has erroneously kept them. The guarantee is also excluded if the defects and / or faults and / or malfunctions derive from a use of the Products other than that referred to in the Contract and / or for which they were designed and manufactured, or in cases of normal wear or deterioration of parts consumables.
  2. If Sportcube finds that any defects or faults of one or more Customer Products are attributable, directly or indirectly to the Customer, he will be required to pay the verification costs incurred for this purpose.

Art. 18 - Right of withdrawal

  1. The Consumer Customer has the right to withdraw from the contract, without stating the reasons and without any penalty, within 14 days from the day in which the Consumer receives the Product.
  2. In the case of a contract relating to multiple products ordered by the Consumer Customer, in a single order and delivered separately, the withdrawal period expires after 14 days from the day on which the Consumer Customer or a third party other than the carrier designated by him acquires physical possession of the last product.
  3. To meet the deadline, of withdrawal The Consumer Customer shall communicate his decision to withdraw from the contract stipulated with Sportcube by registered letter, sending a letter by post, fax or e-mail to the addresses referred to in art. 1 of these General Conditions before the withdrawal period expires. To this end, the Consumer Customer can use the withdrawal form attached to the Instructions on the Right of Withdrawal which, if necessary, can be edited, supplemented, printed and sent by registered e-mail.
  4. Pursuant to art. 54, paragraph 4, of the Consumer Code, the burden of proof relating to the exercise of the right of withdrawal lies with the Consumer Customer, therefore it is advisable that such communication be sent to Sportcube by registered letter with acknowledgment of receipt to the following address:; or by any other appropriate means to demonstrate with certainty the shipment and receipt of communication by Sportcube.
  5. In case of exercise of the right of withdrawal, the Customer is required to return the goods within 14 days from the day on which he communicated to Sportcube his desire to withdraw from the contract pursuant to art. 57 of the D. lgs. 206/2005.
  6. The costs related to returning the products are charged to the Consumer Customer.
  7. The goods must be returned in the original packaging, complete in all its parts (including packaging and possibly documentation) and complete with the attached tax documentation. Without prejudice to the right to verify compliance with the above, Sportcube will refund the amount of the products subject to withdrawal within a maximum period of 14 days, including delivery costs. As foreseen by the art. 56 paragraph 3 of Legislative Decree. 206/2005, amended by Legislative Decree no. 21/2014, Sportcube may suspend the reimbursement until receipt of the goods or until the Customer demonstrates to have sent back the goods to Sportcube. Sportcube will reimburse by bank transfer, and if the Customer intends to exercise his right of withdrawal, he will have to provide Sportcube with the bank details: IBAN, SWIFT and BIC necessary for the reimbursement by Sportcube.

Art. 19 - Effects of withdrawal

  1. If the Consumer Customer withdraws from the contract stipulated with Sportcube, he will be reimbursed for all the payments he has made, including the delivery costs (with the exception of additional costs resulting from his choice of a type of delivery different from the type of standard delivery offered by Sportcube), without undue delay and in any case no later than 14 days from the day on which Sportcube was informed of the Customer’s decision to withdraw from the contract.
  2. The Consumer Customer shall return the goods or deliver them to Sportcube at the following address: via Castelliere, 2 – 33036 Mereto di Tomba (UD), without undue delay and in any case within 14 days from the day on which he has notified Sportcube of his withdrawal from contract. The deadline is met if the Consumer Customer sends back the goods before the expiry of the 14-day period.
  3. The Consumer Customer is only responsible for the diminished value of the goods resulting from the handling of the goods other than that necessary to establish the nature, characteristics and functioning of the goods.

Art. 20 - Cases of exclusion of the right of withdrawal

  1. The consumer customer can not exercise the right of withdrawal provided for by art. 18 (“Right of withdrawal”) in the following cases:
    1. If the goods are tailor-made and / or clearly personalized;
    2. If the goods are liable to deteriorate or expire rapidly;
    3. If the sealed goods, opened after delivery, do not lend themselves to be returned for reasons of hygiene or health protection;
    4. Sealed food once opened;
    5. If the goods, after delivery, are, by their nature, inseparably mixed with other goods;
  2. The Professional Customer can not, under any circumstances, have any right of withdrawal.

Art. 21 - Login Credentials

  1. The Customer is required to keep the access credentials with the utmost care, confidentiality and diligence, committing not to communicate them to others. It undertakes to immediately notify Sportcube of any theft, loss or loss, total or partial, of the access credentials or only a part of them and in any case their unauthorized use by third parties. The Customer will be responsible for any damage caused to Sportcube and / or third parties as a result of failure to comply with the above.
  2. After 180 days from registration on the Site without having made any purchases, Sportcube reserves the right to cancel Customer accounts, even without notice.

Art.22 - Disclaimer for content posted by the Customer on the Website

  1. Each Customer, after registering with the Website, can insert comments, reviews and opinions on the Products referred to in the electronic catalog. This functionality can not be used for illicit purposes or in violation of current legislation, such as, by way of example and not exhaustively, to carry out spamming activities or insert defamatory, libelous, threatening, disgraceful content, violation of privacy and dignity of others personal, etc .; it is also forbidden to insert propaganda messages, advertisements, references to competing websites and companies. The publication of the aforementioned contents is carried out free of charge by the Customer, who may delete the reviews and opinions at any time by accessing the Website with his own credentials. The Customer acknowledges that any content placed on the site could be deleted by Sportcube at any time, for example for the termination of the sale of the reviewed Product or for the closure of the spaces related to comments, reviews and opinions.
  2. Sportcube has no obligation to monitor the activities performed by each Customer on the Site in accordance with this article, as required by Legislative Decree no. n. 70/2003. However, Sportcube reserves the right to remove any content generated by the Customer if it is made aware of or otherwise gains knowledge of the prosecution of an unlawful purpose and / or the violation of one or more of the prohibitions indicated above, and / or an express request is made in in this sense, by a court or administrative body and / or by a third party who is deemed to be injured by the aforementioned contents. In this case, Sportcube will inform the Customer of the aforementioned provisions in any way and will have the right to suspend or cancel his account without notice, without prejudice to any other action for revenge against the person responsible for the violations.

Art. 23 - Changes

  1. Sportcube may modify the contents of these General Conditions at any time and without prior notice.
  2. Any changes made will take effect from the date of publication on the Site, as declared in the header of the General Conditions themselves.
  3. In the case of modifications, unless otherwise agreed upon explicitly agreed between Sportcube and the Customer, the General Conditions in force at the time the contract is signed remain valid for the contracts already concluded.

Art. 24 - Slight fault and limitation of responsibility

  1. SportCube is not liable for damages, even to third parties, possibly caused as a result of its slight negligence.
  2. In any case, any sums due by SportCube for any reason or reason may exceed those paid by the Customer in execution of the Contract.
  3. SportCube assumes no responsibility for disservices due to force majeure or unforeseeable circumstances, even if they are dependent on malfunctions and disruptions of the Internet, if it fails to execute the order within the time stipulated in the contract.

Art. 25 - Intellectual Property rights

  1. All trademarks, as well as any intellectual property, distinctive sign or name, image, photograph, written text or graphic and more generally any other intangible asset protected by international laws and conventions regarding intellectual property and industrial property reproduced on the Website they remain the exclusive rights of SportCube and / or its licensors, without access to the Website and / or from the stipulation of the Purchase Contracts deriving from the Customer any right over the same.
  2. The Customer has the right to access the site for consultation and purchase. No other use, in particular commercial, of the site or its contents is permitted. The integrity of the elements of this site, whether audio or visual, and the relative technology used remain the property of SportCube and are protected by the intellectual property right.

Art. 26 - Other provisions

  1. All purchases of products and services made through the Website and / or Facebook showcase by the Customer that accesses it are governed by these General Conditions and by the other provisions and operating instructions contained in the Site. In the event of conflict between the provisions in the aforementioned provisions and operating instructions and what is contained in the General Conditions, the latter prevail.

Art. 27 - Entirety

  1. These General Conditions are constituted by the totality of the clauses that compose them. If one or more provisions of these General Conditions is considered invalid or declared as such under the law, regulations or following a decision by a court having jurisdiction, the other provisions will continue to have full force and effect.

Art. 28 - Complaints and assistance

  2. Complaints will be processed by SportCube as soon as possible.

Art. 29 - Applicable law and competent court

  1. The Contract is governed by Italian law.
  2. For any dispute that may arise in relation to the application, interpretation and execution of the Contract and that should not find a friendly solution, the Court of Udine will only be competent if the Contract is concluded with a Professional Client, despite the violation, in this case, art. 3.2 of these General Conditions.
  3. Disputes with Consumers are devolved to the jurisdiction of the Judicial Authority of the place of residence or domicile of the Consumer Customer.
  4. Disputes with Consumers Customers residing outside the Italian territory are devolved to the jurisdiction of the Court of Udine, as the judge of the place where the Contract is executed.
  5. In any case, it is possible to optionally resort to the mediation procedures referred to in Legislative Decree no. 28/2010, for the resolution of any disputes arising in the interpretation and execution of these conditions of sale.
